Just a quick warning about a certain loser who is selling R19 items on ebay.

2005malky is his username.

i won an auction by him this weekend just gone

auction

and paid using paypal

Quote:

Dear Simon *******,

This email confirms that you, wlcked_redhead, have paid 2005malky (md_barry2006@yahoo.co.uk) 36.00 GBP using PayPal.

Since the end of the auction i've had no communication from him but i have sent him several emails thru ebay

Quote:

Dear 2005malky,

Hi, i'm still waiting for news on this item. Its been 5 days since i won and paid for this item. No communication from you yet, whats happening? Simon.

thats the last one i sent him, and today i get this from him.

was sold off of ebay, i sent you an email telling you but you still went on to pay. will send you a cheque for the amount shortly

My reply

Quote:

I did not recieve any email from you that you had sold it off ebay.
And why a cheque? you can refund thru paypal as you have an account.

There is also nothing on your auction stating that you had it up for sale anywhere else, and selling the item on ebay is a lawfully binding contract.
I won the item so and have paid so it is now legally your obligation to send me the item.

Regards

Simon

Waiting on a reply back now.

My feeling is that he has sold to someone else off Ebay for a much higher price!

I will be pursueing this rest assured and i'll keep you posted . .

is not there a way to report this to ebay and take action against??

also i remember something about paypals standard insurance up to 500quid ,would take the issue straight to them . if he has a paypal and ebay account he cant get away with this

i nearly bought a set of brand new konis off ebay from him.

What do you want a dark coloured inlet manifold for? itll get hotter quicker and heat up the inlet charge... not exactly performance enhancing!

i am waiting on a reply from him (if i get one that is) before i decide course of action.

Yes you can use Ebays service to resolve problems like this and i will be looking into the insurance thing on paypal.

I have filed a complaint with paypal, now they are also waiting for a response from the seller.

I cant file a complaint with ebay until 10 days after the auction ending.

the auction had less than 12 hours to go so couldnt modify it, i do have another manifold that i can paint for you if you want seeing as i am a proffessional spray painter but you will have to give me 5 days. let me know what you want to do. i will also refund your postage costs, thanks

what do you reckon ? cancel my complaint file and accept the manifold or carry on with the complaint ?

If you decide to take him up on his offer and you actualy recieve the item, then you should consider at least leaving him negative feedback.

I'm sure you've sorted something now (well i hope you have)

If people do mess you about and don't play ball then this is a good site to check out.

time to pursue action against this twat

my email to him

Quote:

Malcolm,
Why am i still waiting for a response from you ?
you asked me to wait 5 days for a replacement manifold and its now been 7 days!

i am fed up with waiting and will now be pursueing my claim by going through Ebay and if need be the Smalls Claims courts.
your name and address is on file with Ebay and they are legally obligated to supply your details for such action.

The only way i will stop this action is if i see a FULL refund paid to me via paypal

the most unfair about it is imo is that if you give them negative feedback they can also give you negative feedback even thou it aint your fault, i sold a pair of headphones a while back on ebay and the guy never paid, so i left him neg feedback and he returned the favour, why should i get neg feedback when the tossa did not pay?

There is the option to add your comment to the feedback they left you and mine was, 'non paying bidder, check these guys feedback', he had also pissed off several other sellers and was very much in the minus figures, shame that was not before the end of my auction.
it has tainted my view on other ebayers who are new or low feedback (even thou they could be honest as the day is long but how am i to know?), i don't accept bids now from ppl with less than +5 pos feedback.
